CONSUMER PROTECTION ACT, 2019

The Consumer Protection Act, 2019 is an important legislation in India aimed at enhancing consumer rights and protection. It replaces the earlier Consumer Protection Act, 1986, and introduces several new provisions to safeguard consumer interests in the digital age. Key features include:

  1. DEFINITION OF CONSUMER: It expands the definition of who qualifies as a consumer, covering transactions through online purchases, tele-shopping, and direct selling.

  2. RIGHTS OF CONSUMERS: The Act emphasizes on the rights of consumers, such as the right to be informed, right to choose, right to be heard, and right to seek redressal.

  3. CENTRAL CONSUMER PROTECTION AUTHORITY (CCPA): It establishes the CCPA to promote, protect, and enforce the rights of consumers. The CCPA has the authority to investigate, recall goods, and impose penalties on misleading advertisements.

  4. CONSUMER DISPUTES REDRESSAL COMMISSIONS: The Act provides for the establishment of Consumer Disputes Redressal Commissions at the district, state, and national levels to adjudicate consumer disputes quickly.

  5. PRODUCT LIABILITY: It introduces provisions for product liability actions, making manufacturers and sellers liable for any harm caused to consumers due to defective products or deficiencies in services.

  6. MEDIATION: The Act promotes mediation as a means of resolving disputes between consumers and businesses.

  7. PENALTIES: It imposes stringent penalties on manufacturers, sellers, and service providers for misleading advertisements, unfair trade practices, and other violations.
